Specific Regulations for Accommodations in Owners’ Associations

As a property owner in a residence with an Owners’ Association in the Valencian Community who wishes to rent to tourists, you must comply with the legal requirements established in Decree Law 9/2024, of August 2, by the Consell:

1. Application for a Tourist Rental License

You must apply for a license from the Generalitat Valenciana. This requires a municipal certificate confirming that your property is suitable for tourist rental (urban compatibility certificate). Your property must meet specific hygiene, comfort, and safety requirements.

2. Consent of the Owners’ Association

For applications after August 2, 2024, a declaration from the Owners’ Association authorizing tourist rental is required (provided the Owners’ Association has not expressly prohibited this type of rental). For existing situations, this is not necessary.

3. Validity and Renewal of the License

The rental license is valid for five years and must be renewed thereafter. At the time of renewal, you must reapply for the municipal tourist compatibility certificate and submit a declaration that the Owners’ Association permits tourist rental.

4. Prohibition of Key Boxes

It is prohibited to place key boxes in public spaces or common areas of buildings.

5. Maximum Rental Duration

Tourist rentals are limited to stays of a maximum of 10 nights. For longer stays, different regulations apply than those for tourist rentals in the Valencian Community, pursuant to Decree 10/2021 and Law 15/2018 of the GVA.

6. Transfer of Property

When the property is sold, the new owner must apply for a new rental license. The existing license is not transferable.

7. Minimum Accommodation Requirements

  • An evacuation plan at the main door.
  • Power outlets in all rooms.
  • Hot water supply.
  • A fully equipped kitchen.
  • Heating at least in the living/dining room.
  • Internet connection (unless there is no coverage in the area).
  • A first aid kit.
  • Detailed information about the nearest medical center.

8. Compliance with Municipal Regulations

Municipalities have the authority to impose additional rules and restrictions on tourist rentals. Therefore, it is important to be aware of your local municipality’s regulations.
